These terms and conditions (the “User Agreement”) apply to your access to and use of the Art’n’Stay platform, including our website, mobile applications, and any other platform or service we may offer (collectively, the “Art’n’Stay Platform”).
By accessing or using the Art’n’Stay Platform, you agree to be bound by this User Agreement, including the policies referenced herein. If you do not agree to this User Agreement, you may not access or use the Art’n’Stay Platform.
- Eligibility
To access or use the Art’n’Stay Platform, you must be at least 18 years old and able to enter into legally binding contracts. By accessing or using the Art’n’Stay Platform, you represent and warrant that you meet these eligibility requirements.
- User Conduct
You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links, and other content or materials (collectively, “Content”) that you submit, post or display on or via the Art’n’Stay Platform.
You agree that you will not engage in any activity that interferes with or disrupts the Art’n’Stay Platform (or the servers and networks which are connected to the Art’n’Stay Platform), or that violates any applicable law, regulation, or Art’n’Stay policy.
- User Content
You retain all rights in, and are solely responsible for, the Content you submit, post, or display on or via the Art’n’Stay Platform. By submitting, posting, or displaying Content on or via the Art’n’Stay Platform, you grant Art’n’Stay a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Content in connection with the Art’n’Stay Platform and Art’n’Stay’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Art’n’Stay Platform (and derivative works thereof) in any media formats and through any media channels.
- Intellectual Property Rights
Art’n’Stay owns all intellectual property rights in and to the Art’n’Stay Platform, including without limitation the design, graphics, and text contained in the Art’n’Stay Platform, and all software and other materials used to provide the Art’n’Stay Platform. You acknowledge that you have no right to use any of Art’n’Stay’s intellectual property rights except as expressly authorized by this User Agreement.
- Disclaimers and Limitation of Liability
THE ART’N’STAY PLATFORM IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. ART’N’STAY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ART’N’STAY DOES NOT WARRANT THAT THE ART’N’STAY PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE ART’N’STAY PLATFORM IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
ART’N’STAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES,
